JCC Holley (Jacksonville) – (Bill Rogner)(11-6-24) – Denied continued medical treatment. The claimant, a school custodian for 29 years, suffered a compensable accident when changing a light bulb on a large light fixture. The E/C accepted compensability of her cervical/bilateral shoulder sprains. She received treatment with Dr. Lurate, who recommended an MRI. The MRI showed degenerative changes. Dr. Lurate placed the claimant at MMI, at which point she requested a one-time change in physicians. The E/C authorized Dr. O’Grady. At this visit, the claimant added that the light-fixture frame fell, striking her in the neck/shoulders area. Regardless, the doctor agreed the claimant was at MMI, with no further need for treatment, as the work-related injuries had resolved. The adjuster filed a denial for any unrelated body parts, but also indicated the claimant could return for her resolved strains. The claimant obtained an IME (Buchalter) (over E/C’s objections of not being properly identified on the Pretrial, not timely identified and being allowed to appear live at the final hearing). The claimant gave the new history of being struck by the light-fixture frame. The JCC accepted the opinions of the authorized doctors. Click here to view Order |
