JCC Jacobs (Miami) (Vanessa Irvin for J&M Amtrust)(2-22-21) – Dismissed claims with prejudice against alleged statutory employers, awarded TPD and treatment with a podiatrist, denied TTD, Ambulance Bill, authorization of plastic surgeon, hand surgeon and hand specialist. A1 Perfect Seal Roof Corp., an uninsured roofing contractor, employed claimant as a roofer. Claimant argued that Spring Lakes, the condo association, and J&M, who provided financial and accounting services for the association, were responsible as statutory employers. The JCC accepted the testimony of the secretary of Silver Lakes condo board, finding the association did not supervise, direct, or control the work A1 performed. The JCC also accepted the testimony of the J&M representative, finding that J&M prepared checks for Silver Lakes to pay A1 and J&M did not hire A1. Therefore, A1 was required to pay multiple hospital bills as the sole employer. Further, the JCC accepted the opinions of Dr. Langone, claimant’s ortho IME, to award TPD.     Click here to view Order
