JCC Hill (West Palm Beach) (Bill Rogner) (5-7-2026) – Granted the E/C’s Motion for Summary Final Order and dismissed PFB for lack of subject matter jurisdiction. The claimant filed a PFB seeking, inter alia, proper administration of the claim, including resolution of outstanding medical charges and protection from collection activity or personal liability arising from treatment related to the compensable injury. The E/C argued that the JCC lacked subject matter jurisdiction, as the E/C had already accepted responsibility for the medical bills, as evidenced by the adjuster’s affidavit. The JCC analyzed Sansone v. Frank Crum and determined that any attempt to balance bill, pursue collection activity or otherwise seek payment directly from the claimant for authorized compensable care is contrary to section 440.13(3)(g). The JCC also found that the claimant may have other remedies against the debt collectors outside of the WC arena, but the JCC lacked jurisdiction to intervene.  Click here to view Order
